      There IS that risk... but searching domain name can be as simple as typing it into your browser, rather than using a domain name registrar to run the search.

    I run a church service that wants to live broadcast sunday services with covers of songs,we paid ASCAP LICENSE are we allow to use the covered music and if so what dono need to include on the videos as far as license number?

      If you've licensed via ASCAP, then as long as the license covers livestreaming/broadcasts, you should be fine. But depending on the platform you're streaming from, you may have to show some proof of the license. That'll vary by platform, and you'll need to interact with them directly. It's unlikely there's an online way to do this.

    What if you want to do a cover of a Weird Al parody song using his exact lyrics? Let's say it's his parody of a Nirvana song. Do you need Weird Al's permission? Nirvana's? Both?

      Great Question. Since Weird Al has negotiated permission for his parodies, that means both he and Nirvana will get royalties if you do a cover RECORD that's authorized by the copyright act AND you pay the royalties required by law... (contact the Harry Fox Agency for this license and to pay these) BUT, if you want to do a cover VIDEO, you still need permission directly from the music publishing company(ies) that control the rights.

    How much should it cost to trademark your RUclips channel name and does my name clarify as a logo or do I have to do both and is the $350 government fee upon approval or before hand I had someone trying to do my trademark for me and I wanted to get a second opinion

      Fees vary widely. You do sort of” get what you pay for”. I’m not a fan of those online legal vending machine operations. I’d recommend using a lawyer who is directly responsible to you for getting the job done right. For a single mark in a single class of goods or services, to pay somewhere around $1500 a logo can be registered separately from the word - mark, which is what I usually recommend, since folks often change their logos more frequently than their actual brand. You don’t wanna get stuck with an abandoned mark as you’re only like to stand on if somebody is infringing The $350 government fee is payable for each class of goods, for each mark. So if registering the logo and word mark separately that would be two fees.

      Sounds like straight up copyright infringement. You can get the offending ad taken down using DMCA, send a cease-and-desist letter, and sue them in federal court. I'd recommend consulting an attorney ASAP

      Watch for an upcoming video about this. short answer is that you automatically own copyright in every episode you create, and registration is not required, though it IS a good idea, at least for cornerstone content.

      I honestly don't know. I don't attend conventions on the specific genre True Crime. But my favorite general podcasting conventions are Podfest (podfestexpo.com) and Podcast Movement (podfestmovement.com)

    I've wanted to do a podcast about Depeche Mode and using their music for years. It's a minefield finding the right people and the difference between doing a RUclips video using the music or podcast using their music. Sony said I could do a video but RUclips would cotton on if it was getting viewers and monetise it. I really just want to plat bits of their songs while i talk. I would be happy to pay a one time licence to allow me to play any DM song if that exists but do I have to seek copyright for every single individual song even if they're nearly all owned by the same publishing company?

      Yes... you need permission for each bit of each song. Also you need permission from both publisher and record label. If they're all with the same companies, you *might* succeed in obtaining permission for the whole thing... but they'll likely expect a royalty structure of some sort. Still, it can't really hurt to ask for what you want. Sometimes the music biz folks will surprise you.

      @@gfiremark I have actually regarding t RUclips . They didn’t seem to have a problem with it but said RUclips May monetise it . I doubt it would attract many listeners tbh. What I really wanted to do was a podcast using their official music. People have done this but are winging it hoping not to get noticed. I want to do it properly. Don’t want to invest my time and effort to be taken down in the first week.

      Sometimes, that complaint is a copyright strike… and too many of those can get your channel deleted…. Sometimes that complaint has a $150,000 price tag. And, it’s always good to actually follow the law, and respect other peoples’ property…

      So these massive shorts channels that use all the inspiration or motivation of podcasts clips, are basically just skating the lines everytime? What im surprised is that youtube doesnt show the creative commons vs the youtube shorts upload option in the description, unless im missing something somewhere maybe? I was going to do a few Sinatra covers but I got chronic Arthritis in the shoulder so my space has been chronic depression bit I belive that if you say this is not my material or my music if you do a covet there is realy nothing illegal about it recording to the governing bodies in our country as long as you not selling it there is no leavel issue our governing bodies 9f music are samrol and sorol

      Well,that’s just be incorrect. Recording a cover is allowed under only certain circumstances, but distributing, performing, and making derivative works still require different permissions. It’s not whether you’re “selling”, you can be liable (or get a takedown) even if you’re giving it away for free…

I have a question im part of a Pro league org in the world of Esport and since im under them can i talk about their website and merchandise that's on sale without saying disclaimer first or can i say one disclaimer that the org does pay me once in the beginning before podcast starts or it has to be before talking about the org merchandise??

      Because you're a player in the league, when you talk about the league, their website and merchandise, it's going to be pretty clear that you/they have a financial relationship. I think it makes sense to do a disclosure at the beginning and end of your episodes... and if you do an overt sales pitch, it's smart to include the disclosure right then, adjacent to the pitch. The FTC guidelines require "clear and conspicuous" disclosure... so more is better. But don't overdo it. Just say something like, "Hi, I'm Gordon, and I play for XYZ Club. Want one of these cool XYZ Club T-Shirts? Get one at XYZClub.com". It doesn't have to be 'hit 'em-over-the-head' kind of thing

      @@markportnoy6290 I think you're mistaken about what's "commercial" in this context. The law views a "commercial use" of a person's name or likeness as when the name/likeness is used in an ad or as a part of a proposal for a transaction. The mere fact that a video is monetized or that there are ads before, during, after or alongside the video does not make its content a 'commercial'. As for YT privacy guidelines, I just went looking for anything in RUclips's guidelines about that... and didn't find it. Can you point me to the page, paragraph or section? (a link would be awesome). Thanks. If what you're saying is correct, then I have been turning away a lot of business from potential clients who want videos they appear in (filmed in public places without their consent) taken down.

      @@gfiremark Commercial use refers to the monetization of a product or service. So yes, when YT channels have paying subcribers and advertisers, the product are the videos themselves and it falls under commercial use. To find the Privacy guidelines, just Google 'RUclips Community Guidelines', scroll down and click, Legal Removals, click Protecting your Identity. All privacy guidelines are explained there. Expressly stating if someone has oploaded a video of you without your consent, the removal process can begin.

      It all depends on the author and publisher. But yes, it CAN be hard. Permission IS a contract, so a lawyer is a good idea to make sure you’re getting the rights you need, but it could be simple, depending on the publisher and the contract they present.
